Содержательно законопроект представляет собой свод временных ограничений при выборе формы и продолжительности лечения пациентов психиатрии. Проект правительства опубликован на портале проектов нормативных правовых актов и находится на стадии планирования.
Ведомство предполагает, что в случае принятия новых правил, они вступят в силу с 1 сентября 2024 года и будут действовать до 1 сентября 2030 года. Проект включает в себя ограничение прав пациентов, при угрозе их здоровью или опасности для окружающих. Минздрав предупреждает, что ограничение прав невозможно только на основе диагноза или из-за нахождения в диспансере.
«Продолжительность устанавливаемых ограничений прав пациента не должна превышать 15 дней, включая день принятия решения. Ограничение прав пациента в случае необходимости может быть продлено, при этом к медицинской документации должно быть приобщено новое решение об ограничении прав пациента, — прописано в документе.
Решение о форме ограничений прав принимается, учитывая текущее состояние пациента, а также потенциальную угрозу вреда здоровью и безопасности как самого пациента, так и других лиц. Пациент или его законный представитель будут уведомлены об ограничениях в течение восьми часов с момента принятия решения лечащим врачом.
Летом 2023 года в России был принят закон, который предоставляет лицам, госпитализированным в психиатрическое учреждение, возможность подавать жалобы и обращения в государственные органы, получать письма и посылки без цензуры, а также встречаться с посетителями и пользоваться средствами связи. Однако, в интересах здоровья пациентов, эти права могут быть ограничены решением лечащего врача или заведующего отделением. Процедура принятия решения об ограничении прав пациентов будет определена нормативно-правовым актом, утвержденным правительством Российской Федерации.
